At least here, they always question the officers qualifications with the radar gun or the Breathalyzer. And that is sometimes enough to get the ticket thrown out, if the officer was not absolutely current in his training with said technology.
It allows a lot of guilty people to walk too ! I have co-workers who got off that way, especially on speeding charges.

You should also subpoena the maintenance records to include the last time the device was calibrated.

Only speeding ticket I've received was in 1986 for going 70 downhill in my '76 Subaru....

I guess I'm just too straight-laced. I think it's wrong to question someone's authority/competency in order to avoid taking responsibility for your actions. I have been to known to speed abit now and then :p: but if I were to get a tocket, I would have to consider it a premium I must pay in order to take that action. My choice; my consequences. It seems like shifting the responsibility just uses more court resources that our tax dollars pay for, and makes it harder for cops to do their jobs. Given the "it's all about me" attitude that is prevelant these days, if people were just turned loose on the roads to do what they wanted, I'm thinking it would be a lot more dangerous.

Not saying that you shouldn't defend yourself when wrongfully accused, but how many of these challenges are from people who done wrong? Just my 2 cents.

It's been a long time since I got a ticket for speeding. When the cop was handing it to me he asked why I was smiling. I said, "I'm thinking about all the times I got away with it."

My last legitimate speeding ticket was in 1983. I was traveling down the interstate doing 70 mph. This was during the Carter Administration when all speed limits were lowered to 55 to save fuel.

The last time actually I got a speeding ticket was a couple of years ago when I got stopped for doing 52 in a 40 mph zone. I decided to fight it because I felt that they were running a speed trap in an area where the speed limit changed 4 times in less than a mile of straight highway travel. It started at 55 mph, then changed to 45 as it passed by a state park (lot of kids, understandable) then went up to 50 and for no reason at all dropped to 40 about 100 yards before I was radared. I took pictures of the highway, signs, distances and like Arlo Guthrie in Alice's Restaurant, I had arrows and circles and a paragraph on the back of each one explaining what each one was.

I arrived in court armed to the teeth with my argument and the officer that issued the ticket didn't show up. Case thrown out. Oh, well. Saved myself a fine and marks on my license by taking it to court. I still felt that I won.

I wouldn't disparage the officer, but I've never had to. In my area, if you show up for your plea, instead of sending it in by mail, they assume you're going to plead Not Guilty and call you over to talk to the prosecutor before hand, who usually offers you to plead down one level from where you were, which I've always been up for 2 point speeding, which a level down from that is 0 point parking violation. I'll take that any day. (4 point speeding they plead down to 2 point running a stop sign.)

Since ANY points here will affect your insurance rate, it is really in your interest to fight the charge. And the points stay on the drivers record for 6 or 7 years. THe ticket might only be $200, but the impact on your insurance could be $1000 a year, until it rolls off your record.
