Family Dog Attacked

I just got off the phone with my father and I am livid- scratch that. There is no word in the English language to describe how angry I am.

We live at the corner of an internsection. The house across the street and from us on the other corner has two german shepherds with a history of aggression toward people. My father jogs 5 laps (5 miles) around the neighborhood everyday, to do that he must go by their house. They have cornered him before and when he talked to them about it they said it was his fault, that by running he was provoking them and he shouldn't pass by their house anymore (he doesn't pass by the front but by the side yard.) Another neighbor of our's had to call 911 when the dogs cornered a woman and wouldn't let her go. The people keep them inside a fence when they are away, but let them out in the yard without leashes when they are there with them and insist that they have control with them- obviously they do not.

Today I found out that our family dachshund Schnitzel was attacked by at leat one of them this weekend. I do not have the full details, but I will say this: He is always on a leash unless he is in our backyard which is fenced, and even then he is not allowed out without any kind of supervision. He is never allowed to roam free. I got this dog when I was in 6th grade, I held him when he was the size of my palm. I pretty much raised this dog, and I am very upset. He is coming up on 12 years old and has some arthritis issues. I don't get to see him much since I no longer live at home, but he is still very special to me, and I am terrified that something bad will happen during surgery.

I want these dogs dealt with. The owners have apparently not said a word to my family, they have not offered to pay the vet bill. Like me, my father is non-confrontational so he honestly doesn't know what he is going to do. At the very least they need to be made to pay the bill since I can guarantee you that it happened either on the street or in our yard as Schnitzel is not allowed out without a leash. Our neighborhood is outside of city limits- so no leash law, but these dogs have shown a history of aggression toward people. I'm assuming the 911 call was documented, so I really want to see some kind of action take. I know this sounds harsh- but at this point I want these dogs euthanized. They have been aggressive toward people, have now injured our family dog. What if it's a kid next time? I realize these are family pets, but clearly there is no responsibility on the part of the owners.

I keep control of my dogs. Neither our dachshund nor my two dogs are ever allowed outside without a leash, putting them in our full control. I expect the same of other dog owners.

EB I'm terribly sorry to hear about this. I hope your dog will be ok.

If they refuse to admit fault, I would seriously consider taking them to small claims for the bill and speaking to the local animal control officer. There should be some documentation from the 911 calls about these dogs being so aggressive towards people.

It makes me sick when people are so apathetic about teaching their dogs and children manners!

First off, I'm sorry to hear what happened.

I agree the first thing you could do is contact your local animal control department. Emphasize to them that the only way this could have happened is if: 1) your parents were out walking the dog on a leash and the attacking dog(s) overpowered them and your dog; or 2) the attacking dogs were trespassing on your property and therefore their owners are responsible for their actions.

I'm sorry to hear about your poor dog. There are way too many people out there that allow this sort of thing to happena and wont take responsibility for it. My neighbor also has two large german shepards, one evening while watering my front yard the male ran at me barking and she was yelling at him to stop, she often lets them out front when she is out there with no leash but I have noticed she doent do it now and I think it is because of the way the dog acted aggressivly towards me. But still, I am cautious before I go out my front door and keep my eyes open when I'm out there because I dont want to get mauled by her dog, and I shouldnt have to be worried about this in my own yard.

As far as living outside the city limits, that doent mean there is no leash law so you might want to look into it. Many states have state leash laws and the counties and cities add thier own to the mix. I know there are some areas, I have seen them in California and Arkansas where if a dog is running loose you have a right to shoot it on sight. This is often due to dogs attacking livestock. Generally, if your dog is on a leash and it is attacked by another dog, even one on a leash then the agressor is at fault. Also, if your dog is on your property then the other dog is at fault. Leash laws dont usually stop at just putting a leash on the dog, you must be in control of the dog at all times. Here in California, if you are bitten by a dog and you have a right to be where you are then the dog owner is at fault, this protects people like the letter carriers, meter readers, power company employees and paper boys who have a right to enter your property to conduct business. As far as you father jogging goes, he has a right to jog in the neighborhood safely and there was a woman killed by dogs here in California I believe while she was jogging and a major court case where the dog owners were tried on criminal charges.

Call animal control which should be a division of your county sherrifs office and file a report. Have them send a deputy out and take a report in person and have them follow up by talking to the dog owners. Good rule of thumb, document, document, document. Once the vet bills are finalized send them a letter asking them to pay the bills, include a copy of the bill, if they refuse send a second letter with a return reciept requested ( check your local small claim for exactly what needs to be done ) and if they still dont pay then take them to small claims. Hopefully small claims in your home state gives you avenues to collect unlike California. Another option is superior court, and yes you should be able to take them to superior court even for amounts under the small claims limits. This would mean hiring a lawyer but once you win they will have to pay attornies fees and court costs.

Before I jump on the bandwagon and blame the owners, is it plausible that your dog got out and visited their yard without supervision? I know you don't have the full details yet, so I'll reserve ranting until we know more.

Oh, please don't blame the breed.

Ktulu: I am 99.9% sure that would not have happened. The few times Schnitzel has run out of the house unleashed, he has stayed in the yard. He is very old and does not move fast. To steal a Harry Potter quote "He has been known to be outstripped by passing butterflies". If he were to somehow get off the leash or out of the fence, my parents would have immediately picked him up and carried him inside (I call it the portapuppy maneuver :) )

The impression I got was that they were on the walk. These dogs have come into our front yard before when I had my two out there on the leash, but the owners were able to call them back that time. I still wasn't entirely pleased with the situation though.

I haven't lived at home in 8 years and these people have been there for less than a year and a half, so I only know what my parents have told me. In the case of the woman who was cornered, 911 was called. I don't know what happened beyond that.

We had a similar problem with a dog a few years ago that was a wolf/husky hybrid. Even though they had a fence they never put her in it- even when they weren't home. She attacked several dogs in their own yards, attacked Schnitzel and I when we were walking (no harm done that time), and even killed a dog. The Sheriff was called multiple times, the owners of the injured animals would come by with the vet bills, but nothing was done at all. We think that family may have had an "in" at the Sheriff's Department. This behavior continued until she got too old to leave her yard.

I did get an update: He came through the surgery swimmingly and will be kept overnight for observation. I was planning on going home this weekend, and now I have to find a pet sitter for my two dogs as it would be unwise to have two rambunctious puppies running around while he is recovering. Thankfully, I have several friends who will do it for no charge, but if one of them is not available they should have to pay to have my dogs boarded as well, since I would not incur that expense if this had not happened.

Once my parents get off work, I am going to get the full story from them.

Animal Control is the first step...they should be called ASAP and your parents should also make a police report.

AWW...poor wiener doggie. Give me their number and I will call them for you. I am in a pissy mood and have no problem telling someone off at the moment. :D:
I agree, document everything, even if it is just that you called them and they didnt answer the phone, everything. :)

I am very sorry this happened to your dog and I'm so glad he's doing ok. Both dogs in the pic are adorable, btw. I agree with others about calling animal control. Is there anyone in the neighborhood who will testify about their behavior? I would be devastated if anything happened to one of my pugs. Hope all goes well.
