Stupid Facebook Tricks

The TOS has changed as of today. They didn't make me re-agree to it, so I took down everything I have ever done that might possibly be for profit. I had to take down an entire album because of the way they changed the terms. I had had copyrights on all these pictures, they are my creative work. I do NOT want Facebook making money off my photography, unless I make money off them making money off it.

Folks, if you have anything from your own imagination or creativity that could ever be of monetary value on Facebook, get it off NOW. By doing so, you might have an argument if they ever decide to use your stuff and you find it.

The scary thing is that if someone else posts said photos, the Facebook TOS covers that as well. Anything ever posted to their site belongs to them, no matter how they got it, where it came from, or whether the person who posted it had the right to give it to Facebook.

While I am fairly sure Facebook is doing this to cover their own arse, and while I am sure they have no plans of selling my stuff, it opens them up to have the right to do so globally. This is not okay. Every photo I have ever taken is copyright, with express license to those I want using the image for any reason.

Oh, well. I guess I'll have to get on with that photography site I've been wanting to start, and just have a link to my site from Facebook.

Hmmm, having worked in an area that concernes itself with data storage and recovery. My question would be, have they archived and/or backed up the images? And if they did, do they consider the images to already be their property?

That might be a little too late if they have done that, and consider the back-up data their property, from the standpoint of "owning" the images/video/data.

Thats why I don't post anything on the interweb, anywhere, (including here) that I don't care if I "lose" it. I still have the pictures on my back up server and other places.

I hope they are giving a grace period for people to remove anything.

Wouldn't the first 4 words of their Content policy cover you?

Except for User Content and Applications/Connect Sites, all materials, content and trademarks on the Facebook Service are the property of Facebook and/or its licensors and are protected by all relevant IP laws and other proprietary rights (including copyright, trademark, trade dress and patent laws) and any other applicable laws. Without limiting the foregoing, FACEBOOK, the F LOGO, FB, FACE, POKE, THE WALL and 32665 and all related logos, are trademarks of Facebook. Except as expressly authorized by Facebook in writing, you agree not to use, sell, license, distribute, copy, publish, stream, publicly perform or display, transmit, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works or otherwise make unauthorized use of the materials, content or trademarks.

I was about to post the same thing, but the "Licensing" paragraph below it contains the real offending stuff. And if what the first link says is true, FB removed a section allowing you to remove your content and therefore cancel their license. We grant them an "irrevocable, perpetual" license to use the stuff we post in any way they want? Pretty scary.

dont do facebook or myspace any more as my computer dies. Two much graphics and stuff or what ever. I only posted a bit but do not have photos thankfully. Thakns for the warning big guy.

More than likely just for Facebook to cover their behind, but still tho... :eek:

They had previously snuck in a license to change the TOS whenever they feel like it. I just stick all my pictures on Flickr and have the flickr app link to them. And BW, you know I will aid with whatever websites you need :)
