Hey! Epcot is one of my favorite parks! There's a lot to do there and some of the best attractions in any Disney Park are there (Test Track, Soarin', Mission Space, etc.). I'll admit it used to be not quite as enjoyable as it is now, especially for the little ones, but they've done a lot to make it better.

Here is a copy of the complaint that was filed. We know someone who is a friend of several characters and she has commented that in several of the outfits your hand is not in the same place as the characters. If you look at a photo of Donald he only has 4 fingers so I would imagine something similar is going on.

I am sure the character noticed that something happened and tried to apologize with gestures. How frivolous ! This is a good argument to adopt the British method of loser pays all legal fees.

Not saying that Donald's friend meant to do any such thing, but the hands in a different place thing doesn't look to be a defense here. It's easy enough to put two fingers down one finger of a glove that size. I imagine that the hands are in the appropriate place for anyone who signs autographs, otherwise the magic would be ruined when they hold the pen.

It certainly seems like a frivolous lawsuit tho... serious physical injury from what was likely an accidental brush of the boob? I read the link... she's not alleging she was punched... but fondled... mental injury certainly comes of that, but physical? Something's rotten in the state of Denmark.

Isn't there something on the tickets that say all lawsuits have to be filed in FL? How are they doing this in PA?

Can I add a second vote for loser pays system?

Normally, a company has to be sued where they are incorporated. However, if a company is large enough like Disney it can be sued at a major office. Disney has a Disney Store there so they served the lawsuit there. It appears they are trying to sue in Philadelphia County. I am sure the Disney will try to get the venue changed. In memory serves they are a Delaware corporation.

The one statement in the lawsuit I noticed in the suit was "As a result of the aforesaid,the Plaintiff, April Magolon, was forced to expend large sums of money for a ruined vacation" It seems like SG's like to throw that phrase "Ruined Vacation" around a lot when things are not going their way.

If you haven't been accidentally groped at the parks please raise your hand...no one? That's what I thought.

The thing is, you cannot live life without accidentally being touched somewhere you don't like, it's impossible unless you run around in a large hamster ball. Accidents happen, it is best to just accept this fact and move on with your life. It is generally very easy to determine if it was an accident or not and this was clearly an accident(if it even happened at all). If someone accidentally brushing up against you ruins your vacation and causes physical harm, perhaps you have bigger medical needs and probably shouldn't be vacationing at WDW where it is almost guaranteed for this to happen.

This case reeks of lawyer...no offense to the member of this profession...who probably agrees. :p:
