2. In the alternative, Disney states that the alleged conduct was not actually an assault, but an attraction intended for the enjoyment of Disney guests.
3. By way of affirmative defense, Disney would show that the perpetrator of the alleged conduct was a waterfowl in the Anatidae family of birds, commonly known as a duck, and that Disney cannot be held responsible for the conduct of wild birds.
4. By further way of affirmative defense, Disney alleges that the only boobs present on the date of the alleged incident were the Plaintiff and members of Plaintiff's party (hereinafter "SG's").
Sounds like you are up for a bit of pro bono work!!

Technical point - Possibly need Wombat to comment.
The pleading refers to Walt Disney Parks and Resorts. There is a Disney Store in Philadelphia. But I thought TDS was not part of WDP&R. Should not the pleading be against The Walt Disney Company?
Maybe Disney will not mention this until the case is going to trial and then the pleading will have to be amended and the case calendared in Middle District of Florida. And the Plaintiff will have to get a lawyer licensed in Florida.

Sorry sorry.
Poo on you. I love EPCOT. It's also hands-down the very best park to do if your party includes any babies. Also, booze.

I was groped very deliberately by Terk once, but I quite liked it.

So, if a person really wants to molest a woman, are they really going to choose to do it on the job, in front of thousands of people, in a suit that nearly blinds them, wearing giant gloves that make it practically impossible to feel anything?
I find that hard to believe.... poor guy was probably just trying to reach for a pen and missed.

I too find it hard to believe, however in my job, I have found that there are some pretty strange things that people get their jollies from. I can see it now "I've finally made it! I can feel up strange women while dressed as, not just ANY duck, but Donald Duck! The comments on my blog said I was f'n goofy, and I say NOT YET!"
Man the Internet is sick...

Wow, lotta flak comin at me!

I didn't know that Epcot was that well defended. :p: I'll admit the last time I was 10 or so. I should probably go back before making fun of it again.
RIP Bud Hurlbut.
You will be missed.

Donald's friend was probably a girl anyway.
"Excuse me, are those ducks real?"
"Yes, sir, but the water is fake."

One of Captain Hook's friends at Plaza Inn at Disneyland likes pinching the ladies' cheeks. I once had to warn him off that his fingers were too strong. Hehe
