He should have been charged. I know that a lot of departments are also charging the people the cost of the rescue, if they ignore warning signs. Did they charge him for that? Raining Furiously here last night, hope the slides don't happen. A few years ago, on the same day people were killed in the La Conchita slide, My son had to be rescued from his school bus by the swift water rescue team because the STUPID school bus driver ignored the "Road Closed" signs, went past and got stuck in the water and mud from a slide. Yup, he was fired.
I'm not sure if he was charged for the rescue, but I called the Highway Patrol the next day to ask if he was driving impaired, they said no but that he was cited for violating traffic laws. They didn't want to talk about it much, probably because it involved the local school district. Since no one was hurt, I let it go (except getting documentation off the NBC website about the incident with pictures) I have been thru enough with the school district on previous occasions regarding my son's safety and am familiar with their refusal to take responsibilty when things go wrong.GRUMPY PIRATE wrote:He should have been charged. Just an FYI, accident reports are available to interested parties. I would have your insurance company get a copy of it from the CHP. I did hear later that illegal grading had caused the slide in the first place, so the business down the road was suing the business up the road, and that supposedly, the extra vehicles in the area/movement during the rescue had caused even more damage from the water that was flooding it.

I am glad to hear that they are o.k., my point is that you can get a full copy, that includes any CVC violations noted, for yourself. and you can release that to anyone you deem necessary. I would get a copy and keep it in case your son starts having back pain, or other delayed symptoms. I have assisted at accidents scenes involving employees in company cars, and a LOT of time they don't start feeling any pain until the next day or a week later!
