Stupid Guest Tricks

And warning labels everywhere. It seems we now have to limit liability by placing a warning on what otherwise would have been common sense. My Pop Tart has a label that "pastry may become hot when heated." Well duh! DLR created a fuss a few years ago when someone was hurt climbing out of the Doom Buggy at HM (hurt or killed, can't remember which). They put up glow in the dark stickers with warnings about remaining seated, etc. that were picked up by the blacklight effects in the attraction. They were distracting as they drew your attention away from the show elements and right to that darn sticker in front of your face.

I've run into the watch liability thing too. Only a select few jewelers will replace batteries now, since consumers are prone to suing if their item is damaged. I now buy cheap watches and just replace the whole thing when the battery dies. It's cheaper and easier than trying to find someplace to replace the battery.

Just over a month ago, I was working on stuff at home and lost track of time. Once I realized what time it was (I was late picking the kids up from school) I ran out of the house and sprained my ankle really bad on a hole between the driveway and the front yard. I called my mom to tell her and after she asked me how I was...she told me I should make the landlord pay for my expenses at the doc office, since it was his yard, his cement, and his hole.

sigh...I couldn't believe it. I was the moron who wasn't looking where I was walking, I was the one who was running late. I am also the one who will trip on air and break something given the opportunity. LOL I'm such a clutz!

I did call him and he had someone come out within the hour to fill in the hole. Otherwise, it was my fault. geesh!

A lot of leases for rentals include a disclaimer that the landlords are not responsible for any injuries while on the property either for the renter or their guests. It does vary depending on local/state laws. We just got renters insurance for $12 bucks a month that covers stuff like that

At least your landlord will come fix stuff like that. I asked mine to clean out the gutter out front.."Oh we will just take that off when we fix the porch " WTF! You cant take down the gutter the water will pour off the roof of the porch. I just had Donnie get up there and pull out what he could while he was painting the porch. I had a small tree growing in it last year for god's sake.

Back on topic (shocker huh?) I was grocery shopping at Sav-a-lot the other day and had on sandals. Walked a little too close to one of those wooden pallets that stores put the big boxes of produce on in the middle of the floor. Nailed my poor toe (the one Meghyn had stomped on earlier in the day mind you :( ) Woman customer standing there asked if I was ok. "I think so" Double checked to see if it was bleeding, nope no blood. OW, that hurt like you know what. The lady offered her name in case I needed it later. I was like OK then, I just stubbed my toe. Granted the area was a little narrow to get through but still, my stupid fault for not watching where I was going. Hey, I was adding up my order in my head. It is hard to walk and chew gum at the same time too. :D:

Tiss a liability thing. They're supposed to have them pallet guards around those pallets if their used as a display. Since you kicked an an unguarded pallet, if you'd injured yourself, they'd be liable, since the pallet guard wasn't on. If you kicked a pallet WITH the guard, well then you're on your own.

When I was 13, I caught my shoelace on an un-guarded pallet of IBC soda, and lost my balance, dropped the six pack of cream sodas I was carrying and fell hands first in the now broken glass, (better than the alternative: :faceplant ) The reaction of store personnel was quite similar. They knew they were in trouble if we decided to sue because the pallet was bare.

Of course we didn't sue, and had no intention of doing it, but it didn't stop us taking their preemptive settlement offer. (It was like, $150 bucks.)

I should say my mother took it. I was the one with cuts all over my hands, and stitches in the backs of my right knuckles for over a month, and I never saw dime one.

Two days after I got the stitches out, I tripped over first base playing kickball at summer camp, popped something in my knee, and spent the remainder of the summer on crutches, but that's a whole different story.

Yeah, what gets me the most is that *I* was at fault. The store was in perfect shape for walking. Only a talented individual such as myself could have managed what I did.

Had the floor been wet, sugar spilled on the floor, etc. I could at least understand people making the suggestion to sue (not that I would have followed up.. depends on the level of negligence on the stores part) but this was crazy.

No, I better not say that out loud at work, they'd probably think it's a good idea.

Your original point is perfectly valid. People are sue-happy to an alarming degree in this country.

You aren't kidding when you say people are sue-happy. I just saw this on yahoos main page. A person is sued for leaving neutral feedback on eBay.

Thats why a lot of people in various professions carry insurance for just that situation. I was talking with my doctor a while back, and he was saying that was why he was working at an HMO, in that they pick up and cover his malpractice insurance. Most Doctors have a problem because of the very high premiums that they are charged.
