That totally reminded me of an incident that happened a long time ago to one of my old roommates. She used to work at the old May Co. at South Coast Plaza in the Junior's Department. The lovely fixtures for clothing known as "rounders" were just high enough to appeal to this kid who insisted on swinging on them like monkey bars. The rounders also happened to be topped with glass - about 1/2" thick so that half displays could be placed upon them. Andi kept telling the kid to knock it off, as well as telling the parents to keep her off of them. And of course she was ignored. And of course, the inevitable happened - the kid swung a little too hard, the rounder toppled over, the glass came down as well and broke putting a huge gash in the kid's arm and forehead. And the parents sued. May Co. ended up settling out of court just to get them to shut up and keep shopping there, but it was so screwed and so totally the family's fault.

I really, really hate it when people get rewarded for bad behavior.

I could never be a juror on a trial like that.
Company laywer," Your honor, the complaintant was told '3' times NOT to hit himself in the head with the hammer in question".
Platiff's laywer," Your honor, while it true my client 'was' warned,he wasn't warned '6' times. Further more there were NO signs above,nor warnings ON the hammers themselves. Therefore I believe my client is entitled to the 1.6 million dollars for his pain and suffering. It is also clear that my client can no longer make clear decisions due to the grevious injurys he has sustained".

Yesterday I saw a young girl in heelies. I told her something to the effect of,"Please walk regularly, and if you can, get the wheels out of the shoes. You don't know when you might have trouble stopping, and there are lots of people around." I of course thanked her, and then went on to clock in.

Actually we need a basic law as they have in the UK concerning civil lawsuits; the losing party pays the legal expenses of the winning party.

To which we need to add that if the Plaintiff loses and cannot afford to pay the defendants legal costs, the Plaintiff's Attorney is liable. Do you know how fast that will cut down on lawsuits.

And related to that, in the category of Class Actions, the Plaintiff Attorney payment will be in the same medium and with the same restrictions as payments to members of the class.

Sounds like the Brits are Eons ahead of us in that regard. You know the other thing I like about them? They don't allow political campaign commercials on t.v. in the two weeks preceeding their elections. Smart people.

Oh I could, and I would love to be the jury forman as well. I would just let the plantiff's lawyer ramble on and on...and I could catch up on my sleep. And you know what, I would be visibly sleeping. :twisted:

Then, at the verdict: "The jury deems the appropriate monatary damages at $0.01. No, not $1.00. Yes, one penny."

But the problem is that many lawyers are pretty adept at picking jurors that lack common sense and are easily played. Most people feel that when they read a story in the news or on TV they are getting the complete story. In most cases that is not correct.

For example, a few years ago, in Philadelphia, a 15 year old girl was raped and killed on the next street over from where she lived. What the news failed to initially report was that the time of the killing was 3:00 AM. Of course it was a heinous crime, but my question was, 'why was the kid doing out of the house at 3 am ?'

Well, that's like that dumb-a** kid who was 12/13, stole an SUV, then tried to run over the cops who were trying to arrest him. They shot him, and it's "police brutality" all over the place, but WTF was that kid doing stealing the vehicle in the first place, and why didn't he just surrender? Ya think he had any personal responsibility for the fact that he got shot and killed??? Naw, let's just sue the L.A.P.D.

No, let's just buy our kids shoe skates that they are too clueless to use appropriately and if they get hurt we'll sue the nearest deep-pocket target we can find.

Exactly. Like I said, I would love to see a) parents sue X company because their kiddie injured himself/herself in a store. b) Company X then sues the manufacturer of those effing things. Yes, it probably would be a trivial lawsuit, but it might just shake them up a little. And, who knows, they might even stop making them. :twisted:
